SUBJECT: New Policies Pertaining to Contract and Lease Management (OP-B-5)
As a result of recent audits by the Office of the FSU Inspector General (IG), certain recommendations have come forth to enhance the uniformity and operational efficiencies of contract and lease activities emanating at the departmental level. Therefore, my office has developed three specific policies pertaining to revenue-generating contracts, leases and general contract and lease management. Adherence to these policies by all appropriate employees will ensure that the University achieves its goals and objectives without undue liability.
Before you read and implement the attached policies, there are several points we wish to emphasize:
- We continue to urge all appropriate individuals to utilize the purchase order for commodities and services. Also, you should continue to work closely with employees of the Purchasing Department when requisitioning commodities and services.
- All non-standard bilateral contracts (all non-standard contracts not utilizing the FSU standard bilateral contract form CS-358), with a contract value of greater than $10,000.00, must first be reviewed by the Office of the General Counsel.
- All revenue-generating contracts of $10,000.00 or more must first be reviewed by the Office of the General Counsel and the Controller's Office before signature and execution. Greater detail about this requirement is included in Policy No. OP-D-3 (Revenue Generating Contracts).
- For those of you utilizing memoranda of understanding or letters of agreement in lieu of formal contracts, please note that they are subject to the review guidelines in this memorandum and attached policies.
The three attached formal policies, as well as the instructions in this cover memorandum, are effective Wednesday, November 10, 1999. Should you have any questions, please do not hesitate to contact the Office of the IG, the Purchasing Department, or my office.
