New Gramm Leach Bliley Act (GLBA) Policy

    1. Supplemental - GLB Amended Safeguard Rule Background

Notice Period:  February 9, 2024 -- March 1, 2024

Purpose

  1. FSU, categorized as a financial institution, needs a policy to comply with updated GLBA requirements. Although we have an existing policy to address GLBA privacy requirements, the amended safeguards rule necessitates a new policy.
  2. The proposed policy was developed with input from the Office of the General Counsel, Information Technology Services, and key FSU departments.
  3. The GLBA Policy replaces outdated GLB language in the 4-OP-H-12 Information Privacy Policy.  The new GLBA Policy is drafted based on approval of the new ITS Security policies. (Replacing the 4-OP-H-12 Information Privacy Policy which we are requesting be retired.)

4-OP-D-2-H Investments

Notice Period:  January 31 -- February 20, 2024

Purpose: The policy is designed to ensure the prudent management of public funds, the availability of operating and capital funds when needed, and an investment return competitive with comparable funds and financial market indices.

Summary of Changes

1.    Increased the maximum allowable allocation for Florida PRIME to 80%.
2.    Provided authority to the University Controller to set and adjust target allocations and created required semi-annual reporting requirements regarding target allocations.
3.    Clarified that proxy voting done by Investment Advisors must follow Florida law.

4-OP-D-2-B Cash Management

Notice Period:  August 23 - September 13, 2023

Purpose of Policy: The purpose of this policy is to provide guidance to help ensure the accountability and safeguarding of university cash.

Summary of Changes: The following changes were made to this policy:

  1. Updated definitions of cash and cash collection point; added new definitions for cash collection point custodian, receipts, electronic fund transfers, and remote desktop deposits.
  2. Updated process for receiving payments by electronic funds transfer and credit cards to provide additional clarity.
  3. Updated deposit process to include guidance on the Departmental Deposit Form.
  4. Updated petty cash and change fund process to further clarify the types of employee advances that are allowed to establish a change fund.

4-OP-H-5 Information Security

Notice Period:  August 18 - September 8, 2023

Purpose of Policy: The FSU Information Security Policy establishes a framework of minimum standards and best practices for the security of data and Information Technology (IT) resources at Florida State University.
 
Summary of Changes: The policy amendment creates and defines Privileged Accounts. Such accounts may be created to allow designated employees access to otherwise restricted accounts and data for legitimate university purposes. The accounts and current users are periodically reviewed and closed when the need or purpose ends.

4-OP-C-7-E1.13 Essential Personnel Designation & Compensation

Notice Period:  July 12 - August 2, 2023

Purpose of Policy:  This policy provides guidance to departments on identifying and compensating essential employees, including Essential Critical Personnel and Medium Priority Personnel, that may be required to work during a University emergency and/or closure. The designation of a University closure shall be made by the University President, or designee. 

Summary of Changes:  The policy updates allow for premium payment for hours worked outside a nonexempt employee's scheduled hours at any point during the campus closure week. Compensatory leave would remain in place for non-essential tasks. The initial policy only provided the premium payment on the day of the closure. Additionally, we adjusted the pay band for exempt employees due to the Segal study to earn compensatory leave while working during a closure.

4-OP-D-1 OMNI Departments

Notice Period:  April 27 -- May 18, 2023

Purpose of Policy:  This policy specifies guidelines and procedures for the establishment and management of departments in OMNI-Financials.

Summary of Changes:  Where Hyperion (our old budget software) is referenced, it was deleted or replaced with ADP (our new budget software). Links to forms/resources on the Budget Office website were updated/added. The term “federally” was removed with regards to sponsored projects. (While we previously focused on federally sponsored projects alone, per SRA, we have broadened that to all sponsored projects). Additional edits include:

  • A.1.a.i. – Removed reference to specific University mission
  • A.2.b. – Deleted limit on number of budget/salary preparers (we limited Hyperion due to license restrictions, but have no reason to limit with ADP)
  • A.8. – Incorporated references to new functionality/process to inactivate departments

University Policy – 4-OP-E-7 Unmanned Aircraft Systems Operation Policy

Notice Period:  September 21 - October 12, 2022

Purpose of Policy: To provide an official University policy pertaining to use of unmanned aircraft systems on property owned and managed by Florida State University.
 
Summary of Changes:

  1. Deleted information about FSU’s Certificate of Authorization (COA) and COA Coordinator, as the COA has expired and was not renewed.
  2. Updated to reflect the Final Rule changes to 14 CFR Part 107, Small Unmanned Aircraft Systems: operations over people, operations over moving vehicles, night operations, and remote pilot knowledge test.
  3. Added information about Section 934.50, F.S., which restricts which drone manufacturers the University can utilize.

University Policy – 4-OP-C-7-H2 Graduate Assistants

Notice Period:  August 19 - September 9, 2022

Purpose of Policy: This policy is meant to implement provisions of terms of employment for Graduate Assistants, including use of appropriate job codes, workload limitations, standards and training requirements, and terminations. This policy is consistent with terms outlined in the FSU/BOT GAU Collective Bargaining Agreement.
 
Summary of Changes:

  1. Removed reference to IRS FICA tax exemption for all graduate assistants in the Introduction.
  2. Added language under Workload to reflect updated FICA exemption policy that GA’s working less than 30 hours per week will receive FICA exemption.
  3. Added new GA job code - M9183 Graduate Teaching Associate.
  4. Updated language on full-time student status requirement to provide clarification and remove reference to summer session “letters”.
  5. Updated language on outside activity to specify that it will be permitted unless there is a conflict of interest.

Policy 4-OP-E Emergency Management

  • Notice Period:  April 18 - May 9, 2022
  • Purpose of Policy:  This policy serves as the administrative foundation for the Florida State University Emergency Management Program. This policy outlines the delegation of authority for Program implementation and the Program’s primary administrative responsibilities. This policy does not serve to outline’s roles and responsibilities during emergency operations; rather, such information is outlined in the Florida State University Comprehensive Emergency Management Plan and other emergency plan, policies, and procedures developed and maintained by departments across the University.
  • Summary of Changes:  The changes to the policy are substantive as we self-assess plans and policies utilizing Emergency Management Accreditation Program (EMAP) standards. EMAP is an independent non-profit organization that fosters excellence and accountability in emergency management programs by establishing credible standards applied in a peer review accreditation process. The revisions to this policy include multiple standard requirements not currently addressed by FSU’s Emergency Management Program.

  • Notice Period:  April 14 - May 5, 2022
  • This policy is meant to implement the provisions of the Social Security Act which provides an exemption from FICA taxes to enrolled students who are regularly attending classes while employed by the University and whose employment is incidental to their pursuit of a degree. This exemption does not apply to professional employees who may take courses or pursue a degree while employed by the University.

Policy 4-OP-D-5 FICA  Policy and Student Enrollment

  • Notice Period:  January 26, 2022 - February 9, 2022
  • This policy is meant to implement the provisions of the Social Security Act which provides an exemption from FICA taxes to enrolled students who are regularly attending classes while employed by the University and whose employment is incidental to their pursuit of a degree. This exemption does not apply to professional employees who may take courses or pursue a degree while employed by the University.
  • Summary of Changes:
    1. Moving policy from Research to Finance & Administration (7A-13) and renumbering accordingly as this policy impacts all graduate students, not just research assistants.
    2. Updating format of policy to better comply with Policy 2-1.
    3. More clearly define conditions for FICA exemption for students by clarifying language around hours worked and credit hours.
    4. Clarify rules for ineligibility for full-time employment and for graduate assistantships between semesters.
    5. Update specific authority.

  • Notice Period:  October 6 - 27, 2021
  • This policy provides guidance on awarding individual bonus or incentive payments to recruit and retain employees and to reward superior work performance. Eligible categories of employees include Faculty, Executive Service (AEX), Administrative and Professional (A&P), and University Support Personnel System (USPS). Employees must be active and in good standing with the University at the time a bonus payment is made.

  • Notice Period:  July 1 - 22, 2021
  • Certain emergency events may result in the suspension of normal University activities to ensure the safety and security of students, staff, and faculty. For some emergencies, such as impending weather, the University closure period may be different from the imminent threat period. This policy categorizes the employees that may be required to work before, during, or after a University closure as Essential Personnel and Medium Priority Personnel. This policy also outlines compensation for these roles during a University closure event.

This policy  provides eligible new parents a paid leave of absence to assist in balancing their work and family matters. FSU offers eligible staff employees the option to take one paid leave of absence during their University employment not to exceed six weeks following the birth or placement of a child through adoption occurring on or after August 1, 2021.

Policy name:   4-OP-7-E1.12 Paid Time Off for Postdoctoral Scholar Employees [New]

Purpose of Policy: This policy outlines the accrual and use of paid time off (PTO) for postdoctoral scholars. 

Summary:

This is a new policy to provide Paid Time Off (PTO) for postdoctoral scholars.

Under the new policy, postdoctoral scholars will be able to accrue PTO to use for sick or vacation purposes.

PTO will be accrued at a rate of 4 hours per pay period, not to exceed a total balance of 104 hours.

4-OP-C-7-E2 – Sick Leave Pool

Purpose of Policy: To establish a procedure outlining the requirements to join the Sick Leave Pool and to establish the proper procedures to request the use of Sick Leave that is available to the employee through the Sick Leave Pool.

Summary of Changes:

•    Shortened requirement for medication certificate from 2 weeks to 1 week. 
•    Aligned language with new regulation language.

o    Reworded language to allow an exception to complications with pregnancy/childbirth.
o    Added an exclusion for pre-existing conditions unless necessitated by a catastrophic event.

4-OP-C-7-L Employment of Relatives (Nepotism) Policy

Purpose of Policy:  

This policy ensures a fair and measured approach to employment of relatives and avoids the conflicts that can arise from nepotism. The objective of this policy is to emphasize that employment actions will be based on job-related qualifications.

Summary of Changes:

•    Definition of “relative” is updated to include other persons residing in the same household. 
•    Definition of “line of authority” is updated to reflect research related terms (e.g. Principal Investigator, reporting effort). 
•    New section added to detail relationship conflicts in supervising research personnel. 
•    Administration: Added disciplinary action as a possible result of failure to comply with the policy. 
•    Updated Legal support and justification of policy based on research related laws, policies, and standards of conduct.

4-OP-C-4 – Health Services

Purpose of Policy:  

This policy defines eligibility for the use of University Health Services, emergency services and payment issues.

Summary of Changes:

  • Added language to include a one-semester grace period for students enrolled in the immediate past term, which allows the student to continue to receive services.
  • Spouses of eligible students, minor dependents aged 13 and above, and purchasers of the TCC FSU pass were removed as eligible members to receive services.
  • Spouses of eligible students and minor dependents aged 13 and above, are now included as FSU Visitors who are eligible for treatment of minor illness or injury. 
  • Academic dive physicals and nutrition counseling were removed from the list of services available for faculty and staff.
  • Departmentally required immunizations were added to the list of services available to faculty and staff.
  • Spouses and minors are no longer permitted to defer charges to the associated student’s account.

It includes definitions, access by administration and supervisors, and public records and retention requirements.

Policy 4-OP-C-7-B11 Criminal History Background Checks

  • Stylistic revisions throughout aimed at improving organization and readability.
  • Substantive revisions to match policy language to current background check processes.
  • Expanded how long the results of a previous background check of the same level stay valid before a new check needs to be performed for current employees:  from 90 days, to 1 year.

Policy 4-OP-C-7-G8 License Requirements for Operating University-Owned Vehicles

Clarifies throughout that license validity must be verified through the DMV of the state of issuance.

Section II(1)(d): clarifies that employees must immediately stop driving for work if their license is suspended.

Section II(2):  clarifies that, for employees who don’t drive university vehicles for their job duties, but occasionally drive a university vehicle, the department is required to check license validity before the individual is permitted to operate a university vehicle.
